Terms and Conditions (Effective 26th of October 2025)
There's a bit of reading, but it's good to know your rights!

This page will detail a contractual agreement between you and me. The terms of a contract is:

Offer: One party proposes specific terms for an agreement

Acceptance: The other party clearly agrees to those terms

Consideration: Both parties exchange something of value (goods, services, money, or promises)

Mutual intent: Both parties must intend to create a legally binding relationship
-
Legal purpose: The agreement must involve lawful activities

Henceforth, the artist will refer to @monteblanque.bsky.social (the owner of this BlueSky handle as of 26th of October 2025), me, the service provider.
​
Customers will refer to recipients of the services rendered.
The agent will refer to the middle man of service, that is flashgit125 (the owner of this Discord handle as of 26th of October 2025)

These actors and these terms are subject to change by the owner of the BlueSky handle @monteblanque.bsky.social as of 26th of October 2025. These changes may or may not be done with prior notice, but the artist will generally try to keep his customers informed.

Accepting services from the artist implies acceptance of the following terms, caveats and all.

Offer:​

Service Rendered

Illustrations tailored to specific demands of customers. This service is subjected to verbal agreement from the artist or agent for commencement. Without this verbal agreement, the service is rendered null and will not be provided to the customer.​​​

Animations tailored to specific demands of customers. This service is subjected to verbal agreement from the artist or agent for commencement. Without this verbal agreement, the service is rendered null and will not be provided to the customer.​

Illustrations involve but not limited to:
-
Digital art provided of any subject based on the specific demands of the customer. This may include background or lineart or without.​

Traditional art provided of any subject based on the specific demands of the customer. This could be done of any physical medium if requested by the customer.

Pixel art provided of any subject based on the specific demands of the customer. This may include background or outlines or without.
-
Designs (character, scene, setting or any related media that requires design) provided of any subject based on the specific demands of the customer.

The above without the direct aid of Generative AI.

Direct aid of Generative AI refers to:
-
Direct feeding of images or text to Generative AI models to generate illustrations.​

Tracing of images generated via Generative AI.
-

Animations involve but not limited to:
-
Animation done of illustrations of only digital and pixel art, which may be aided by any Non-Generative AI methods.

​Generative AI methods refers to:​

Direct feeding of images or text to Generative AI models to generate animations.​​

Proof of Authenticity:​
-
The artist recognises the need for authenticity in the age of Generative AI, the artist will try to accomodate request of proof of authenticity as best as he is able, but recognises that complexities of emotion and circumstances may make it difficult to satisfyingly prove authenticity. The artist can give his word (as of 26th of October), and that, among with the proofs he will aim to provide, is the best he can do.

For Illustrations:​​​

In the context of doubt or equivocations (once presented with evidence of direct aid of Generative AI), the customer can request the artist to show a process time lapse of the art to prove authenticity.

Once time lapse of the art to prove authenticity has been provided, whether customer doubt is relieved has no purchase on a refund.

For Animations:

In the context of doubt or equivocations (once presented with evidence of generative AI methods to generate animation), the customer can request the artist to show a brief screen recording snippet of the animation software running the animation.​

Once the screen recording snippet has been provided, whether customer doubt is relieved has no purchase on a refund.

Due to housekeeping and freeing of storage space, the proving of this authenticity has a 3-month window. Once that 3-month window has past after payment, the artist no longer hold the burden of proof of authenticity, and the customer loses the rights to valid refund due to fraud.

Terms of verbal agreement:

A verbal agreement involves:
-
An acceptance of service with any definitive affirmative language with a date timestamp via the agent and the artist in any medium of written or typed communication after mutual agreement between agent and artist. In case of disagreement, the artist's decision has veto against the agent.

Reason will often be provided to customers of refusal of service, but in cases of discomfort, the artist may refrain from providing the reason.

Infringement of Brand and Image

Infringement of Brand:
-
The customer must not use illustrations nor animations provided as part of service rendered in any form of Generative AI activity.​

Generative AI activity includes but not limited to:
-
Feeding illustrations or animations provided as part of service rendered as:​
-
A prompt in generative AI​
-
To generate other illustrations, animations or media through use of generative AI whatsoever.
-
Data for training generative AI models.
-

Generative AI refer to AI such as Grok, ChatGPT, Gemini and the like.
-

Infringement of Image:​
-
Illustrations and animations provided as part of service rendered are jointly owned by the artist and the customer, any unlawful or unscrupulous use of illustrations and animations provided as part of service rendered infringes upon the image of the artist and the customer will lose rights to illustrations and animations provided as part of service rendered, not including products of such unlawful or unscrupulous acts.​​​

Unlawful or unscrupulous acts involve but not limited to:

Pedophilia​
-
Hate crimes
-
Direct discrimination and racism
-

The artist does not affiliate with customers nor their motives and goals when the customers perform such acts through the use of illustrations or animations provided as part of service rendered. The artist may not necessarily align with nor condone certain lawful but morally questionable use of such illustrations or animations.

Example case study:​

John orders a character to be drawn and designed by the artist. The character is a minor. John uses the design to commission child pornography. John loses rights to the character designed by the artist, and child pornography as a product of the design by the artist has no affiliation to the artist, nor does the act of condoning child pornography.​

Losing rights to an illustration or animation involves:
-
The barring of further public posting of the illustration or animation as part of service rendered to any social media.​
-
Initial design of character (if applicable) is barred from being used for further point of reference by the customer, whether it is being used as reference for other commissions.

The artist respects creative freedom as long as it respects the basic rights of any person, the use of the illustrations and animations provided as part of service rendered for otherwise reasons than unlawful and unscrupulous acts above is free.​ (The artist couldn't care less if you commissioned him to make an adult character as a reference to get porn, for example.)

The artist reserves the right to rescind rights to the illustration or animation as part of services rendered in most cases of questionable acts as written in Infringement of Image, Losing rights to an illustration or animation, especially if it causes the endangerment of an individual. The artist does not condone these acts whatsoever in its moral sense.

Questionable acts involve but are not limited to:

Procurement of porn with questionable consent​

Endangerment of other individuals
-
Snuff
-
Other violating acts against human rights
-

Regardless of the artist's decision, it does not necessarily reflect his views or moral standing regarding such acts.

Repeated infringement may put the customer in a blacklist, where the artist will always refuse to provide service to that customer until further notice.

Rules of Engagement:​

Refer to rules in the Homepage.​ Answers from the FAQ in the Slots page apply as well.

In the event of inability of provision of services rendered due to any reason, not limited to mental incapacitation, physical loss of ability, or loss of tools, etc., the artist will always try his best to give the customer a refund, as long as there are at least 1 avenue to provide such refund.

In the event of death, in the artist's words: "I'll generally try to tie any lose ends if I choose to die, but in the case I die and I can't give you what you're owed, I can only apologise in advance."

Note that refunds are only applicable as written in Proof of Authenticity and also inability to provide services. Inability to provide services ONLY involves an absence of a concrete deliverable. Customer satisfaction has no purchase in a refund, but the artist will generally try his best to meet expectations.

Loss of contact from the customer after the deposit has been provided counts towards the days of voiding deposit refund, after which the artist may choose to cancel the commission. The customer may reinstate (without paying the deposit again) by providing valid extenuation reasons.

The workflow pipeline for illustrations is as follows:

The artist is commissioned with verbal agreement from both parties​

​The artist provides a sketch as proof of concept.
-
If the customer finds it suitable, they may pay the 40% deposit.
-
The customer then waits for the piece to be done.
-
Once the piece is done, an extremely low resolution picture with a watermark will be given to the customer for first-level checking.
-
If they seem happy with the outcome, they may pay the remaining 60%.
-
The illustration is then sent to the customer in a Google Drive link to maintain quality.

The workflow pipeline for animations is as follows:
-
The artist is commissioned with verbal agreement from both parties​
-
The artist provides a storyboard, rough animation, or whatever applicable to the type of animation (for instance, in sprite animation it would be a rough animation blocked out by several different coloured body parts in motion, etc.)
-
If the customer finds it suitable, they may pay the 40% deposit.
-
The customer then waits for the piece to be done.
-
Once the piece is done, a low resolution animation in a GIF file or any other appropriate file format will be sent to the customer for first-level checking.
-
If they seem happy with the outcome, they may pay the remaining 60%.
-
The animation is then sent to the customer in a Google Drive link to maintain quality.​​

※ Note: For animations, it is generally advised to download the video within 3 months as animations can take up a lot of space. The artist cannot guarantee link validity after those 3 months. To avoid mishaps, the customer should download the video as soon as they can. The artist is not liable for any loss of animation commissions were it not be recoverable.

※ The workflow is only a guideline. The artist may stray from the workflow mainly for the benefit of the customer in order to garner more trust and assurance that the piece is in the works. The artist does not want to make any customer feel abandoned, so if he sees a risk, he will try to allay the customer's fears.
​
※ Before step 3, the artist may delay the initial sketch depending on emotional, mental and physical resources. After step 3, the artist will generally try to speed things up.

Acceptance:

Customers must make a pledge before requesting services from the artist. The pledge must be written as follows in any written or typed communication medium:
​
"I, (customer name, handle, or unique, identifiable appellation), on (date, timezone), have read the terms and conditions of the services rendered by the owner of the BlueSky handle, @monteblanque.bsky.social (as of 26th October 2025), and agree to adhere to it to the best of my ability. I acknowledge any consequences if I were to break the agreement."

*Any parameters in underlined parentheses should be replaced with the appropriate information relevant to the pledge at that time and place and people involved.

The pledge will be screenshotted for record keeping, and the agent must always provide the link to the Terms and Conditions and make known to the customer that the pledge will be screenshotted as a verbal agreement.

The screenshot will involve the customers' handle for unique identification, but will not be released to the public unless any proof of innocence or indictment is needed by any court of law or charge against the customer.

By speaking the pledge, the customer explicitly agrees to adhere to the Terms and Conditions that was effective on the date of the pledge.
Consideration:

The artist will provide illustration(s) or animation(s) as detailed in Offer, Services Rendered
-
The customer will provide renumerations to the artist according to terms provided by either the artist or the agent based on their appraisal of price, using the commission sheet as a guideline.

Mutual intent:​​

After verbal agreement by the agent and artist as detailed in Offer, Terms of Verbal Agreement, the customer must provide a verbal pledge as detailed in Acceptance.

The verbal contract will henceforth be sealed, and both the artist and the customer will follow to the best of their ability in the terms written, especially that written in Offer.

Legal Purpose:

The artist and customers are subjected to the laws of their respective countries and must comply with legal bodies if need be.

Whatever views I may have or whatever I do, my agent may not necessarily align with nor condone my views or actions.
​
In the event of a indictment from court, the artist can only be sued in his home country, Malaysia.
​

In any case, it is subject to common sense, and approached with a mindset of kindness.

Anything before the effective date of this Terms and Conditions are not retroactively applied, but do have at least SOME modicum of respect for me, please. I'm not asking much, it's as much as calling someone a funny name that would make them happy, in which case, just respect the core wishes of these terms.
